Welcome to BookThis.Now® ("Service," "we," "our," or "us"). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

2. Description of Service

BookThis.Now® is a platform that enables property owners to:

• Create and manage property listings
• Generate QR codes for their properties
• Connect multiple booking channels (Airbnb, Booking.com, VRBO, etc.)
• Sync calendars from external platforms
• Accept direct bookings (Pro plan)
• Track analytics and manage reservations

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By registering, you represent and warrant that you meet these requirements.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate, current, and complete information

4. Subscription Plans and Payments

4.1 Free Trial

New users receive a 7-day free trial (unless otherwise stated from time to time) with full Pro features. No credit card is required to start the trial. At the end of the trial period, you can choose a subscription plan or your account will automatically downgrade to the free tier.

4.2 Subscription Tiers

We offer the following subscription plans:

• Free Plan: €0 — includes property microsite, QR codes, and calendar sync
• Pro Plan: €59/year — includes direct bookings, advanced analytics, and priority support

4.3 Payment Terms

Pro subscriptions are billed annually in advance. All fees are in Euros unless otherwise stated. We use Stripe for payment processing. By providing payment information, you authorize us to charge the applicable fees.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial months or unused time, except as required by law.

5. Property Listings and Content

5.1 Your Responsibility

You are solely responsible for the accuracy and legality of your property listings, including:

• Property descriptions, photos, and amenities
• Pricing and availability information
• Compliance with local laws and regulations
• Having the right to rent or list the property

5.2 Content Standards

You agree not to post content that:

• Is false, misleading, or deceptive
• Infringes on intellectual property rights
• Contains offensive, discriminatory, or illegal material
• Violates any applicable laws or regulations

5.3 License to Content

By uploading content to our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and promoting the Service.

6. Bookings and Transactions

6.1 Booking Process

BookThis.Now® facilitates connections between property owners and guests but is not a party to the booking transaction. You are responsible for:

• Honoring confirmed bookings
• Communicating with guests
• Resolving disputes with guests
• Complying with booking platform policies

6.2 Direct Bookings (Pro Plan)

Under the €59/year Pro subscription, all platform features are included at no additional cost. However, if you elect to accept credit card payments through Stripe, a payment processing fee of approximately 5% applies to each transaction. This fee only applies to credit card payments — all other Pro features are included free under your subscription. You are responsible for:

• Setting accurate pricing and availability
• Processing refunds if needed
• Tax collection and remittance
• Compliance with consumer protection laws

6.3 Calendar Synchronization

We synchronize calendars from external platforms (Airbnb, Booking.com, etc.) to the best of our ability, but we cannot guarantee 100% accuracy. You are responsible for managing your availability across all platforms.

7. QR Codes and Stickers

We provide QR code generation and optional professional sticker printing services. You agree to:

• Use QR codes only for legitimate property marketing purposes
• Not modify or manipulate QR codes to redirect to unauthorized content
• Place QR codes in appropriate, legal locations
• Take responsibility for the physical placement and maintenance of printed materials

Sticker orders are fulfilled by third-party printing partners (Prodigi). Delivery times and costs are subject to their terms and conditions.

8. Referral Program

Our referral program allows users to earn rewards for referring new users. By participating, you agree to:

• Not engage in spam or deceptive marketing practices
• Only refer genuine prospects
• Comply with all applicable laws regarding referrals and rewards

We reserve the right to modify or terminate the referral program at any time and to withhold rewards for fraudulent or abusive activity.

9. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to our systems
• Use automated scripts or bots without permission
• Collect user data without consent
• Reverse engineer or attempt to extract source code
• Use the Service for any illegal or fraudulent purpose

10. Intellectual Property

The Service, including its design, code, features, and content (excluding user-generated content), is owned by BookThis.Now® and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary materials
• Use our trademarks without permission
• Create derivative works based on our Service
• Remove or alter copyright notices

11. Third-Party Services

Our Service integrates with third-party platforms and services, including:

• Booking platforms (Airbnb, Booking.com, VRBO)
• Payment processors (Stripe)
• Printing services (Prodigi)
• Mapping services

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for their actions, policies, or service availability.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Accuracy or reliability of content
• Security of data transmission

We do not guarantee specific results, bookings, or revenue from using our Service.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKTHIS.NOW SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from third-party actions or service failures
• Issues arising from property listings or bookings

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless BookThis.Now®, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your property listings or bookings
• Your violation of these Terms
• Your violation of any rights of third parties

15. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Prolonged inactivity
• Any reason at our sole discretion

Upon termination, your right to use the Service immediately ceases. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

16. Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where BookThis.Now® is registered, without regard to conflict of law principles.

16.2 Informal Resolution

Before pursuing formal legal action, you agree to contact us to attempt to resolve the dispute informally.

16.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

17. Changes to Terms

We may modify these Terms at any time by posting the updated version on our website. Material changes will be communicated via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BookThis.Now®.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
